Customer Notice and Communication
As you learned from us(Open a new window) and as widely reported in the
news(Open a new window), on March 4, 2022 Microsoft Corporation (Microsoft) completed the acquisition of Nuance Communications Inc., including its affiliates and subsidiaries (Nuance) and as such Nuance became a Microsoft company. Today, we inform you that, in furtherance of this acquisition, effective August 1, 2023 Nuance staff will automatically transfer by operation of law and become staff of Microsoft entities in the respective geographies.
This does not change your contract and your Nuance counterparty remains Nuance Communications Ireland Ltd. or Nuance Communications Inc. (as applicable) and that entity will continue to act as processor on your behalf for personal data processed in accordance with the terms of the contract and DPA. Where the EU Standard Contractual Clauses apply, Nuance Communications Inc. will continue to be the Data Importer.
As a result of the staff transfer, insofar as Microsoft are already listed as sub-processors for the purposes of providing certain services (specified in the DPA Sub-Processor List), the change will be that Microsoft, who engage certain affiliates, will provide sub-processing activities to the same customer and professional support services which are currently performed by Nuance staff located in the same geographic location.
